CollectPay Online, Online Payment Program ("OPP") is a third-party OPP which
Mid-America Carpenters Regional Council Benefit Funds Office, LLC
("MACBenefits") uses to process electronic payments for remittance of employer
contributions made on behalf of employees in the St. Louis Carpenters Fringe
Benefit Funds.
By using CollectPay Online, employer: (1) understands and acknowledges that
their payment is being processed by CollectPay Online, a third-party banking and
financial service vendor; (2) agrees to ensure that the employer's designated
financial/bank account is and remains accurate and valid; and (3) agrees that the
employer is fully responsible for any such transactions.
By using CollectPay Online, employer (1) authorizes CollectPay Online to store
the employer's designated financial/bank account information; and (2) authorizes
CollectPay Online to automatically debit the employer's designated financial/bank
account in the amount reflected on funding commitments submitted by the
employer to MACBenefits.
By providing CollectPay Online with the employer's banking/financial institution
information and agreeing to these terms and conditions, employer authorizes
CollectPay Online to debit their bank/financial institution account so that the
funds are transmitted to MACBenefits as close to the business day designated by
the employer as reasonably possible.
If the online payment is not made or if the employer's financial institution does
not send the payment as directed for any reason including insufficient funds,
invalid account information, bank or payment account closure or suspension or
similar circumstances – employer understands that they may be subject to the
collection procedures adopted by the applicable Board of Trustees or other funds
for which MACBenefits has been delegated authority to perform collection efforts.
It remains the obligation of the employer to make timely contribution payments.
In no event shall CollectPay or MACBenefits be liable to any party for any direct,
indirect, special or other consequential damages arising out of any use of the
OPP.
